Under limited supervision of the General Counsel and Deputy General Counsel, provides legal advice and counsel to the state Director of Public Health and public health program managers and staff in specialized areas of health care delivery, health care policy, and public health services and initiatives. Drafts and reviews contracts prior to agency release. Advises agency staff on state and federal health privacy, statutory and regulatory matters, including HIPAA and HITECH; provides assistance in the development of agency policies and procedures, training and compliance. In addition, responsible for the supervision and management of assigned staff to ensure prompt and high quality legal services. Represents the public health programs before the Board and in litigation. Conducts complex research; drafts opinions and memoranda. Provides information and recommendations on administrative matters such as staffing, personnel actions and organizational needs. Responsible for drafting and reviewing legislative bills and regulations. Responsible for representing the agency in legislative hearings, as necessary. Advises Office of Public Health Preparedness on emergency response activities related to Public Health program services. Assists the General Counsel in advising and providing legal support to the agency Director and DHEC Board. Responsible for providing legal support for complex and sensitive public health investigations and interventions.
Minimum and Additional Requirements:
This position requires a Juris Doctorate degree and membership in good standing of the South Carolina Bar at the time of commencing duties. Applicant must have at least 3 years’ experience as a practicing attorney. Experience in health law, or education in a health-related curriculum, or training and experience in a health-related industry. Ability to conduct complex legal research, handle and oversee complex and sensitive legal matters and litigation, express conclusions and arguments clearly and logically, and communicate effectively. Ability to develop work plan and direct professional staff in legal activities. Must be well-organized with demonstrated ability to work independently.
Prefer applicant with at least 1 year management and supervisory experience, leadership training, and experience in crisis management.
