A primer on e-discovery: How to promulgate it, how to comply with it and how to oppose it.\n \nOver the last 10 years, the use of ESI in matrimonial litigation has increased exponentially. With an ever-growing amount of social media and electronic communication tools available today, it is becoming more difficult to know which resources to target for finding useful ESI.\n \nKnowing how to quickly retrieve, utilize, and introduce ESI in an efficient manner is an absolutely essential skill for any successful matrimonial law litigator. Where people travel, with whom they socialize, how they spend their time, and what they think can now be culled from a host of electronic sources, providing attorneys with a vast amount of information to assess for potential value.\n \nTo help you hone your ability to sift through the plethora of electronic sources commonly used today and distinguish what information can best serve your case, the South Carolina Chapter of the AAML and the SC Bar CLE Division have planned a comprehensive Morning Session seminar featuring AAML Fellows James A. Hennenhoefer, APC and Gordon Cruse, APC. You will hear the experts provide you with practical tips to help you access and utilize ESI with ease, as well as insight on topics such as:\n\n Definition of ESI and metadata\n Federal and State rules regarding the handling and admissibility of ESI\n Stored Communications Act\n Preservation orders\n Authentication\n Hearsay\n Admissibility\n Best Evidence Rule\n Electronic Discovery Act\n Duties of attorneys in litigation\n Unauthorized access\n Sanction for failure to produce ESI\n “Deletions”\n Financial Records\n Social Media\n Strategic use of ESI\n\n\n\n\nAfternoon Session\n\nThe Afternoon Session is free to all registrations who wish to take advantage of learning Advanced Technology Tips through hands-on demonstrations.
